SEX OFFENDER REGISTRATION RELIEF
ELIGIBILITY
To be eligible to have your registration requirement lifted the following criteria need to be met:
Class “A” Felony at Age 15 or Older – RCW 9A.44.143(2):
- I am requesting waiver from registration for class “A” felony sex or kidnapping offense(s) committed when I was 15 years of age or older;
- At least 60 months (5 years) have passed since I was adjudicated and released from confinement, whichever is later;
- I have no additional sex offense or kidnapping convictions or adjudications within 60 months (5 years) of filing this petition;
- I have no convictions or adjudications for failure to register within 60 months (5 years) of filing this petition; and
- I have not been determined to be a sexually violent predator as defined in chapter 71.09 RCW.
Class “A” Felony Under Age 15 or Any Other Type – RCW 9A.44.143(3):
- I am requesting waiver from registration for class “A” felony sex or kidnapping offense(s) I committed when I was 14 years of age or younger; or, for sex or kidnapping offense(s), other than a class “A” felony offense, I committed when I was 17 years of age or younger;
- At least 24 months (2 years) have passed since I was adjudicated and released from confinement, whichever is later;
- I have no additional sex offense or kidnapping convictions or adjudications within 24 months (2 years) of filing this petition; and
- I have no convictions or adjudications for failure to register within 24 months (2 years) of filing this petition.
- I have not been determined to be a sexually violent predator as defined in chapter 71.09 RCW.
INSTRUCTIONS
1) To determine if you are eligible for relief of registration, read the information below or consult with an attorney. This process and paperwork is only to be used for offenses that were charged in Cowlitz County only, or if your conviction/offense was outside of the state of Washington. If your conviction is from another county in Washington State, you must file in that county.
2) If you believe you are you eligible, complete the “Request Relief of Registration” form.
3) In order to complete the Request and Petition you will need the following information:
- The court number of your case
- The offense and date of offense
- The date of conviction and your age when the offense was committed.
If you do not have this information you can ask the clerk to provide it to you at Cowlitz County Youth Services Center. You will need a valid photo ID (Driver’s License, Passport etc.) if you need the clerk to provide this information.
4) When you complete the Request Form and submit to the Clerk you will be given a packet of information that includes:
- Copy of Completed Request
- “Petition for Relief of Duty to Register”
- “Notice of Respondent’s Motion for Relief of Registration” with court date.
- Sample copy of Petition and Notice.

5) You will need to make copies of the Notice and deliver to them to:
- Cowlitz Prosecuting Attorney, 312 SW First Ave., Kelso, WA 98626
- Cowlitz County Sheriff, 312 SW First Ave, Kelso, WA 98626
- Washington State Patrol, 1823 Baker Way, Kelso, WA 98632
6) It is important that you begin to gather the documentation described in section “B” of the Petition and make copies for the court and the Prosecuting Attorney’s office. This documentation should be as detailed as possible. For example, the completion of treatment along with the dates.
7) Bring in the completed original Petition, the Notice and the Section “B” documentation to the clerk a minimum of two weeks before the Court Date. You will sign the documents and the clerk will file them.
8) Appear in court. Be prepared to answer questions that the court may have for you.
9) If the court relieves your Duty to Register, the court order will be sent to you and to the Sheriff’s Department in the county you are registered. It is wise to go to the Sheriff’s office in person to confirm that they have received notification that your requirement has been lifted.
10) This process will not Seal or Destroy your juvenile record and it will not remove the conviction from your record, that is a separate process.
