Updated Eviction Summons Policy

The Superior Court for Cowlitz County has reviewed concerns raised by Bar Association members related to the summons form set forth in RCW 59.18.363 which indicates a specific time of 5:00 p.m. as the deadline. It is presumed that time was chosen to align with the normal close of business. It creates a dilemma as the Cowlitz Clerk's office closed to the public at 4:30.

Concerns were also raised as 5:00 p.m. is a different time than the time used by the Order to Show Cause for Writ of Restitution, which is aligned with a civil docket commencement time.

After review of the competing interests, and recognizing that using a 5:00 p.m. time may be confusing to litigants, the Cowlitz Bench will accept summons which use either the statutory 5:00 p.m., or the 4:30 close of business as a valid summons.

Use of any other return deadlines on the summons form will result in your writ being denied until a proper summons is filed.

The effective date of this policy change is 17 March 2016 and it will be applied to all cases presented for signature after that date.
